Any deviating terms and conditions of the guest shall apply only if their application has been expressly agreed.
Individual agreements shall always take precedence over these General Terms and Conditions.
The price, payment, cancellation and other rate conditions displayed to the guest before submission of the binding booking and subsequently reproduced in the booking confirmation shall also apply to the respective booking.
2. Conclusion of the Contract and Incorporation of These Terms and Conditions
The accommodation contract is concluded when the booking has been confirmed by Breckwoldt & Pöppe Service GbR.
Bookings may be made in particular:
- through the guesthouse website,
- through the SiteMinder booking platform,
- by e-mail,
- by telephone, or
- through an external booking platform.
The presentation of available rooms on the website does not constitute a binding contractual offer. By completing the booking process, the guest submits a binding offer to enter into an accommodation contract. The contract is concluded upon receipt of the booking confirmation.
For bookings made through external booking platforms, the terms and conditions displayed to the guest on the respective platform before submission of the binding booking shall apply in addition to these General Terms and Conditions.
Individually agreed terms and any effectively incorporated price, payment, cancellation and other rate conditions applicable to the respective booking shall take precedence over these General Terms and Conditions.
Where a person makes a booking on behalf of additional guests, that person is responsible for informing the additional guests of the terms and conditions relevant to the contract.
These General Terms and Conditions shall only become part of the contract if the guest is informed of their application before conclusion of the contract and is given a reasonable opportunity to review their contents.
For bookings made by telephone or e-mail, these General Terms and Conditions shall be provided to the guest electronically or made available through a directly accessible link before the contract is concluded.
3. Services and Provision of Rooms
Breckwoldt & Pöppe Service GbR is obliged to make the booked room available for the agreed period and to provide the confirmed services.
The guest shall only be entitled to a particular room if that specific room has been expressly confirmed in the booking confirmation.
Occupancy of the room is limited to the number of persons stated in the booking. Any additional occupancy requires prior approval and may be subject to additional charges.
The room may only be used for accommodation purposes. Subletting or otherwise allowing unregistered third parties to use the room is not permitted without prior approval.
4. Arrival and Departure
The applicable arrival and departure times are set out in the booking confirmation or in the information displayed during the booking process.
Earlier arrival or later departure is permitted only by prior arrangement and subject to operational availability. A separate charge may be agreed for this service.
If the guest is unable to arrive within the agreed arrival period, the guest should notify the guesthouse as early as possible.
In the event of a failure to arrive without prior notification, the cancellation and no-show conditions effectively agreed at the time of booking shall apply.
A late arrival does not generally affect the guest’s payment obligations.
5. Prices and Payment
The prices displayed to the guest before submission of the binding booking and subsequently reproduced in the booking confirmation shall apply.
The final prices stated for consumers include the statutory value added tax applicable at the time the contract is concluded.
Additional public charges or other costs shall only be charged if the guest was informed of them before completing the booking.
The total price must be paid at the time and by the payment method specified in the booking confirmation.
Depending on the rate booked, an advance payment, credit card guarantee or other payment security may be required. The conditions displayed to the guest before completing the booking and subsequently reproduced in the booking confirmation shall apply.
In the event of late payment, the statutory provisions shall apply.
6. Cancellation and No-Show
The cancellation conditions applicable to the respective booking shall be displayed to the guest before completion of the booking and subsequently reproduced in the booking confirmation.
A cancellation should be submitted through the same booking channel used for the reservation or in text form, for example by e-mail.
Where the guest has booked a non-refundable rate or a rate subject to specific cancellation conditions, the conditions displayed before the booking and expressly agreed shall apply.
Where no specific cancellation conditions have been agreed, the statutory provisions shall apply.
If the guest does not use the booked accommodation for a reason attributable to the guest, the claim to the agreed remuneration shall generally remain in effect.
However, Breckwoldt & Pöppe Service GbR must deduct any expenses saved and any benefits received by renting the room to another guest.
The guest shall remain entitled to demonstrate that the amount payable is lower due to expenses saved or because the room was rented to another guest.
In the event of a no-show without an effective cancellation, the cancellation and payment conditions effectively agreed for the respective booking shall apply.
7. Shortening of the Stay
If the guest arrives later or departs earlier than contractually agreed, the claim to the agreed remuneration shall generally remain in effect.
However, Breckwoldt & Pöppe Service GbR must deduct any expenses saved and any benefits received by renting the room to another guest.
Any deviating provisions effectively agreed for the respective booking and any mandatory statutory rights of the guest shall remain unaffected.
8. Withdrawal or Termination by the Guesthouse
Breckwoldt & Pöppe Service GbR may withdraw from or terminate the contract in accordance with the statutory provisions if continuation of the contractual relationship cannot reasonably be expected.
This may apply in particular if:
- the guest fails to make a due payment despite receiving a reminder and being granted a reasonable payment period,
- the guest intentionally or with gross negligence provided materially incorrect information when making the booking and, taking all circumstances into account, Breckwoldt & Pöppe Service GbR cannot reasonably be expected to continue the contractual relationship,
- the guest intends to use the room for an unlawful or unauthorised purpose,
- the safety of other guests or of the business is materially endangered,
- the guest seriously or repeatedly breaches an agreed smoking prohibition or material house rules, or
- the guest intentionally causes or threatens to cause substantial damage.
Any warning or grace period required by law shall remain unaffected.
If the booked room cannot be provided for a reason attributable to Breckwoldt & Pöppe Service GbR, any payment already made for services not provided shall be refunded.
Any further statutory rights of the guest shall remain unaffected.
9. Obligations of the Guest
The guest must treat the rooms, furnishings, equipment and communal areas with due care.
Any damage or defects must be reported without undue delay so that they can be inspected and, where appropriate, remedied.
The guest shall be liable in accordance with the statutory provisions for any damage culpably caused by the guest, accompanying persons, visitors or other persons within the guest’s sphere of responsibility.
Smoking is prohibited in the rooms and in all communal indoor areas.
Animals may only be brought onto the premises with prior approval. Approval may depend on the type, size and number of animals as well as the operational circumstances. Assistance dogs shall be accommodated in accordance with the applicable statutory requirements.
The guest must show consideration for other guests and local residents and must avoid preventable disturbances, particularly during night-time hours.
10. Defects and Remedial Action
If the guest identifies a defect, the guest should report it without undue delay.
Breckwoldt & Pöppe Service GbR shall thereby be given the opportunity to inspect the defect and provide a remedy within a reasonable period.
If the guest fails to provide a reasonable notification, the guest’s claims may be restricted to the extent that the failure to provide notice prevented remedial action.
The guest’s statutory rights shall otherwise remain unaffected.
11. Liability
Breckwoldt & Pöppe Service GbR shall have unlimited liability:
- in cases of intent and gross negligence,
- for damage resulting from injury to life, body or health,
- under the provisions of the German Product Liability Act, and
- where a guarantee has been expressly provided.
In the event of a slightly negligent breach of an essential contractual obligation, liability shall be limited to the foreseeable damage typical for the contract.
Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose fulfilment the guest may generally rely.
In all other respects, liability for damage caused by slight negligence is excluded to the extent permitted by law.
The statutory provisions, in particular Sections 701 et seq. of the German Civil Code, shall apply to the loss, destruction of or damage to property brought onto the premises by the guest.
The statutory liability provisions applying to property brought onto the premises by guests shall not be restricted by these General Terms and Conditions.
The guest is requested to report any loss or damage without undue delay after becoming aware of it.
12. Lost Property
Lost property shall be retained for a reasonable period.
At the guest’s request, lost property may be returned at the guest’s expense.
Items that have not been collected shall be handled in accordance with the statutory provisions after a reasonable retention period has expired.
13. Data Protection, Cookies and Booking Platform
Personal data is processed in accordance with the Privacy Policy published on the website.
The SiteMinder booking platform is used for online bookings. SiteMinder provides the booking functionality and parts of the website’s technical infrastructure.
Further information about the processing of personal data, service providers used, retention periods and the rights of data subjects is available in the Privacy Policy.
Information about cookies and similar technologies, the categories used and the granting, rejection and withdrawal of consent is available in the Cookie Policy.
The Legal Notice, Privacy Policy, Cookie Policy and these General Terms and Conditions are provided separately on the website.
14. No Right of Withdrawal for Date-Specific Accommodation Services
There is generally no statutory right of withdrawal for contracts concerning accommodation services that are to be provided on a specific date or during a specific period.
The agreed cancellation conditions and the guest’s statutory rights shall remain unaffected.
15. Consumer Dispute Resolution
Breckwoldt & Pöppe Service GbR is not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
16. Applicable Law
The laws of the Federal Republic of Germany shall apply.
For consumers, this choice of law shall apply only to the extent that it does not deprive the consumer of the protection provided by mandatory provisions of the law of the country in which the consumer has the consumer’s habitual residence.
17. Place of Jurisdiction
The statutory rules governing jurisdiction shall apply to consumers.
For contracts with merchants, legal entities under public law or special funds under public law, the registered place of business of Breckwoldt & Pöppe Service GbR shall be agreed as the place of jurisdiction to the extent permitted by law.
18. Final Provisions
Individual agreements shall take precedence over these General Terms and Conditions.
If individual provisions of these General Terms and Conditions are or become invalid, or have not been effectively incorporated into the contract, the validity of the remainder of the contract shall not be affected.
Where a provision is invalid or has not been effectively incorporated, the relevant statutory provisions shall apply in its place.
Amendments to these General Terms and Conditions shall apply exclusively to contracts concluded after publication of the amended version.
The version effectively incorporated into the contract at the time the respective booking is concluded shall apply to that booking.
Individual amendments to an existing contract require an agreement between the contracting parties.
